Since the beginning of the 1990s Kenyans have been debating the constitutional and legal order in the country and the changes necessary to that order to facilitate the evolution of multi-party democracy. In 1990 in response to intense popular agitation for constitutional reforms, the de jure one party KANU government appointed the "Saitoti" Review Committee to which many Kenyans made representations. As a result, in 1991 Section 2A of the Constitution which legalised the one-party state was repealed and in 1992 multi-party elections were held though still in an old constitutional and legal environment. After the elections the Attorney General established several Task Forces whose mandate was to review specific areas of law to facilitate legal reform consonant with a multi-party democratic order. This book features the research findings of the Centre for Law and Research International (CLARION) in the area of both constitutional and law reform presented by the Saitoti Committee and Task Forces.
